Restaurant businesses

Anyone wishing to operate a catering trade requires a permit (§ 2 Gaststättengesetz)

 

The permit is granted by the District Office of Würzburg - Trade Law Department -, Zeppelinstr. 15, 97074 Würzburg.

Trade Regulation Act

Excerpt from Section 14, Paragraph 1 of the Trade Regulation Act:

 

„(1) Anyone who commences the independent operation of a stationary trade or the operation of a branch establishment
       or starts a dependent branch office, this must be reported to the competent
       Report to the authority at the same time. The same applies if

 

  • operation rescheduled becomes
  • the purpose of the business changed or on goods or services extended that are not customary for commercial enterprises of the registered type,
  • or the operation abandoned "will be."“

Business registrations must always be notified to the local municipality, in whose municipal territory the permanent establishment is located.


The place of residence of the business owner is irrelevant for this.

Commercial re-registrations must be made when:

 

  • operation within the municipal area rescheduled becomes 
  • and/or the object of the business changed or on goods or services extended that are not customary for commercial enterprises of the registered type.

Business deregistrations are required when:

 

  • operation abandoned (this also includes cases where the business is continued by another person, e.g., through a sale, who must then register in turn)
  • the operation to another location, to another municipal territory rescheduled becomes
    (here the business must be deregistered at the „old“ location and registered at the „new“ location).

The administrative fee for a business registration, business re-registration, or business deregistration
amounts to 25.00 euros each.

 

Depending on the type of business, other or additional approval procedures may be required:

 

  • for a restaurant business, for example a restaurant license
  • in a itinerant trade, for example a hawker's permit
  • etc.

The Central Trade Register is a central procedure maintained by the Federal Ministry of Justice.

 

The application for an extract from the central trade register is submitted in person at the town hall/trade office or by an authorized representative.

 

A central trade register extract costs 13.00 euros.

Street cleaning and clearance profile

The following clearance profile applies to roads and walkways and must be kept free of vegetation from hedges, bushes, and trees:

 

  • 4.50 m above the entire roadway
  • 2.50 m above footpaths and cycle paths

 

Also for roads and paths without a sidewalk, it applies that from the edge of the road 1 Meter must be kept appropriately clear for pedestrians and cyclists and these streets must be cleaned in accordance with the „Regulation on the Cleanliness and Cleaning of Public Streets and the Securing of Walkways in Winter“.

 

The cleaning obligation under this regulation includes not only winter snow removal, but in particular also the removal of leaves, fallen fruit, grass, and weed growth.

 

Where obstructions to traffic—including pedestrian and school routes—exist, the road traffic authority will take action as necessary and remind [parties] of the required trimming or cleaning. In the event of persistent disturbances, fines may also be imposed.

 

Maintenance pruning may be carried out all year round—always, of course, when traffic is disrupted—and major pruning may be carried out from October to February (outside the growing season).

Only possible if (winter) parking bans are observed.
(Please use existing parking spaces and garages and avoid parking on the roadway if possible!)

 

Do not throw the snow cleared from properties onto the road, as the cleared sidewalk will then usually be covered in snow again when the snowplow passes!

The effect of road salt only begins when the roadway is largely cleared of snow, which is why the use of a snowplow is often necessary beforehand.

 

Only possible if (winter) parking bans are observed.
