The building authority can be divided into various functional areas using three main headings, namely

Planning
Building regulations
– Building maintenance for public buildings and facilities

The „face“ of the municipality is developed through spatial planning and land-use planning.

 

In this context, the land-use plan, which sets the „broad direction,“ as well as individual development plans derived from the land-use plan, are prepared in the building authority—usually in cooperation with suitable urban planners and/or engineering firms—and submitted to the decision-making body for a vote.

 

Of course, the building authority cannot make arbitrary decisions regarding these plans; naturally, it is bound by existing legal regulations. In addition, it is necessary to cooperate with higher-level authorities and bodies representing public interests, as well as to take their objections and suggestions into account in the respective planning.

 

Likewise, the responsibilities of the construction office employees also include development planning with streets, their lighting, supply and waste management, and of course the maintenance of the water and sewerage sector.

An exemption from approval can be applied for if the construction project is located within the area of a valid development plan. The content of building regulation law is compliance with the planning law established by „planning,“ meaning that the authority must examine whether the specific project complies in each individual case with the land-use planning existing for that area.

 

In other words, it must be examined whether the individual project complies with the provisions of the respective valid development plan, in particular whether access to utilities and roads is secured or whether the construction project within the town center blends into the surrounding area.

 

It should be noted that the building authority sees itself as a mediator between prospective builders and decision-makers, and not as a „construction prevention office.“.

The building authority maintains all public buildings and facilities owned by the market town of Rimpar.

 

These public buildings and facilities include, for example, the Gramschatz community center, daycare centers, fire stations, water supply and sewage systems, gymnasiums and sports facilities, playgrounds and sports fields, streets and sidewalks, as well as parking lots and schools in all parts of the municipality.

Due to the 2008 amendment to the Bavarian Building Code, simple structures in particular can now be exempt from approval procedures.

 

Procedural freedom means that an application procedure and a review of public law regulations by the authority do not take place; the builder or their planner is solely responsible for the review and admissibility

 

To clarify in individual cases whether an approval requirement or an exemption from procedures applies, or whether a project can be started by means of the approval-free procedure (only if a legally binding development plan exists), an appointment with the building department is recommended.

We recommend inquiring by phone in advance about the modalities regarding payment and collection of the site plan.

The building administration can inform you (also by phone) upon notification of your property's plot number as to whether your property lies within the scope of a valid development plan at all.

It is more difficult to inquire about the entire provisions of a development plan, which are often very extensive, in this way.

Here it is advisable to consult the building authority and have an excerpt from the relevant development plan prepared. There is also the possibility of obtaining a copy of the respective development plan for a fee at the building authority of the market town of Rimpar.

Basically, it must be said that the neighbors are to be involved in the building permit procedure.

 

If neighbor signatures are missing when submitting the building application to the municipality, the municipality can notify the neighbor – upon application by the builder – and set a deadline for their comments, provided the neighbor has not already refused to sign in writing.
